Terms of Service

1. Acceptance of Terms

By accessing or using Danalus ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Danalus provides an AI-powered lead qualification platform. Clients install a chat widget on their website that engages visitors, qualifies them using AI, scores leads, and delivers them to the client's dashboard with notifications.

3. Plans and Billing

The public founding real-estate pilot is $499 for setup and $99 per month. A written private offer or valid promotional code may reduce the setup fee and will state its expiry, limits and included scope. Work begins after payment and scope confirmation. Website design, domains and third-party services are separate unless explicitly included. Setup fees cover configuration and implementation work and are non-refundable once work begins. Monthly service may be cancelled before the next billing date.

4. Acceptable Use

Clients agree not to:

• Use the Service to collect data in violation of applicable privacy laws (including GDPR)
• Install the widget on websites with illegal, harmful, or deceptive content
• Attempt to reverse-engineer, decompile, or access the Service's internal systems
• Resell or redistribute the Service without authorization (except via the white-label Scale plan)
• Use the Service to send unsolicited communications (spam)

5. Data Responsibility

Clients are responsible for ensuring they have a lawful basis to collect visitor data through the widget on their website, including obtaining necessary consent where required. Clients are responsible for their own privacy policy and compliance with applicable data protection laws. Danalus acts as a data processor on behalf of the client (data controller).

6. AI Limitations

The AI qualification system uses language models to analyze conversations and generate lead scores. While we strive for accuracy, AI-generated assessments are not guaranteed to be correct. Clients should use their own judgment when acting on lead qualifications. Danalus is not liable for business decisions made based on AI-generated lead scores.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime, data loss, or service interruptions caused by factors beyond our control, including third-party AI providers, cloud infrastructure, or network issues.

8. Limitation of Liability

To the maximum extent permitted by law, Danalus's total liability for any claim arising from the Service is limited to the amount paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Cancellation

Clients may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period. Setup fees are non-refundable. Upon cancellation, client data is retained for 30 days, then permanently deleted unless otherwise requested.

10. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Spain.
